Terms of Service

Payment

- Recipient must pay 50% of total commission cost upfront. The remaining cost will be paid upon completion of piece.

Progress

- Artist will share progress with recipient upon completion of each stage of the commission (rough sketch, cleaned sketch, lines, color, then shading). More updates will be provided upon request or as needed.- Communication is required whenever progress is shared. If the recipient does not communicate when contacted by artist. Progress on commission is liable to be slowed or halted completely. Refund will not be issued if inactivity persists, however it may be negotiated.- Recipients are permitted to request as many changes as needed before color is applied to commission. Once color is applied recipient may make up to 3 minor changes. Large changes after color is applied will add a $5 USD convenience fee to remaining payment.- All progress shared will be heavily watermarked, upon completion of commission and final payment, the recipient will receive an unwatermarked copy of the artwork for personal use.- Deadlines may be requested by recipient, must give a minimum of 2 weeks. Art will be finished within a month of the first payment unless communicated otherwise by the artist.

Refunds

-If the Artist is unable to complete the Recipient's commission for any reason, the artist will issue a refund for what amount has been paid.-In the case of icon sets, the recipient will only be refunded for the incomplete portion of the set, artist will keep money for completed parts.-Refunds will not compensate for any transaction costs through paypal or other mode of payment. Once a commission has been completed refunds will no longer be available.-refunded recipients will reserve ownership of incomplete commission and are free to use incomplete work as they wish so long as proper credit is given to artist.

Usage Rights
& Artist Credit

- Proper credit must be provided to artist on any and all complete or incomplete commissions. Links must be provided to the artist's toyhou.se or other social media if possible.- Commission is free to be used for personal use.- Sketch, Lineart, Flat Color or incomplete commissions may be completed by the recipient if they so wish. Credit must still be provided for altered commissions.- You are not allowed to commission someone else to finish unfinished commission pieces by the artist.- Commission may not be used for use in NFTs or used with AI models.- Permission must be granted before commission can be used commercially. Any intention to use commission for commercial purposes must be disclosed beforehand.Artist reserves the right to refuse service to anyone or cancel commission for any reason. If a payment has been made recipient will receive refund.

Design T.O.S.

The Artist/Designer may not revoke ownership of art or design for any reason, however, violation of any of these guidelines may result in the commissioner being blacklisted from future purchases and services provided by artist.Legal action may be pursued in case of the commissioner using designs to promote content that is considered directly slanderous or incriminating towards the artist.- All sensibly applicable terms under the artist's usage rights and artist credit terms apply to both commissioned artwork as well as designs.- Credit must be provided to the Artist for design.- If major changes are made to the design the recipient may include themselves in the design credits alongside the original designer credits.- if the recipient loses interest in the original design for any reason, they are highly encouraged to contact the artist to have the design repurposed. Artist may not forcibly revoke designs for any reason or purpose.- The artist may not sell forfeited designs for any more than what it was originally commissioned for, unless artist adds additional artwork themselves.- if the recipient does not wish to return design to the original artist, the recipient may sell the design for the designs base value or value upon purchase. If the recipient adds additional artwork to the design, the value of the added artwork may be added onto the design's base value.
